HOSTING POLICIES

All Strong Webs accounts are bound by Strong Webs' policies. Violation of these policies can result in warnings, account suspension, termination of service, or in some cases, fines or legal action.

Lawful use
Customers may not use Strong Webs’ facilities and capabilities to conduct, or solicit the performance of, any illegal activity, or to conduct any other activity which infringes on the rights of Strong Webs or any third party.

Inappropriate material
Strong Webs accounts may not host or handle material that contains nudity, pornography, adult material, obscenity, discriminatory/hate propaganda, "warez", material which promotes the illegal distribution of software, or any material that results in reasonable complaints from other customers or third parties.

Intellectual property rights
Customers may not upload or transmit any message, data, image or program that would violate the property rights of others. This includes the unauthorized transmission of copyrighted text, images, music, programs, or trade secrets or other confidential proprietary information, trademarks, service marks or trade names used in an infringing manner.

Customers may not upload or transmit any information which is libelous or defamatory, or which violates or infringes on any right of privacy of any person.

Interference with service
There shall be no attempt to gain unauthorized access to Strong Webs systems or accounts, disrupt service or network connectivity, misuse Strong Webs facilities, or create fraudulent accounts.

Viruses
In the event that any virus or destructive element is found or furnished with any content, the customer will use their best efforts upon learning that such situation exists, to immediately eliminate the virus or destructive element. Customer will notify Strong Webs as to the existence of any such virus or destructive element immediately upon discovery thereof, and Strong Webs will have the right to take any steps it deems necessary to eliminate the virus or destructive element and to be reimbursed by the customer for its costs relating to any such commercially reasonable steps.

"Junk email" (SPAM, flames, and mail-bombs)
Strong Webs servers and Strong Webs-hosted domains may not be the source, intermediary, or destination address involved in the transmission of junk email, nor will they be listed in any junk email message. The use of Strong Webs servers to send or relay junk email is prohibited, and may result in a fine.

Strong Webs defines "junk email" to be a mass unsolicited message in any medium. Violation will result in immediate termination of all services without refund. Fines and legal action may be imposed. Any customer who is repeatedly flamed/mail-bombed or attracts such behavior will be asked to leave.

Strong Webs' mailing list services are provided for use as discussion forums only, and may not be used to distribute unsolicited email. All users on a list must have personally subscribed to that list.

Subhosting
Strong Webs services are provided for end users only. No subhosting or resale of any services, for fee or for free, is permitted without the express consent of Strong Webs. This includes email options, web space, traffic, CGI and FreeCGI.

CGI usage
CGI, FreeCGI, SSL, Miva, HTML Script, and other CPU-intensive features utilize server CPU-time which is drawn from a common pool shared by all users on a particular system. Any site which monopolizes the CPU, causes disruption of service, or negatively impacts server performance will not be allowed. Strong Webs reserves the right to immediately terminate any harmful CGI process.

Resource limits
Strong Webs does not meter overall traffic or disk space on its standard accounts. Due to their unique resource characteristics and hit patterns, pre-defined limits are imposed on certain file types. These file types (audio, video, and binary files), in total per account, may account for no more than 5 GB of site traffic per month, and may account for no more than 100MB of disk space. Excess resource usage will be billed.¹

Certain types of sites typically exceed the above limitation. Such sites include file/download archives, mirrors, and other sites with a primary purpose of file distribution.

Accounts used as a backup facility, or which negatively impact other customers, are prohibited.

Email resources
Strong Webs does not meter email storage. However, customers typically notice performance degradation when their email box exceeds 10MB. Email accounts may not be used for permanent storage. Read mail (left on the server) is subject to removal after 30 days.

Customer privacy
Strong Webs respects the privacy of its customers, and will not sell or trade the names and addresses of its customers. Strong Webs does not require customers to be listed in Strong Webs' customer directory. Strong Webs reserves the right to provide contact information upon request in matters relating to potential legal action, flagrant abuses, as required by law, or when appropriate contact information can not be found on the customer's Web site.

Criminal prosecution
There are numerous federal, state and international laws regulating the use of the Internet. Strong Webs will not hesitate to initiate criminal prosecution and/or cooperate with government agencies relating to abuse of Strong Webs' services or systems.

Refusal of service
Strong Webs reserves the right to refuse service to anyone at its sole discretion.

Promotional services and prices
Strong Webs may cancel specials or promotions at any time for any reason. Prices and services are subject to change at any time, and prices are only guaranteed for the initial period of prepayment.

BILLING POLICIES

Forms of Payment
Strong Webs accepts personal/business checks, money orders, or International money orders in U.S. currency, drawn from a U.S. Bank.

Billing Procedures and Period:

Hosting and Mrketing Services
At the customer's option, accounts are quarterly, semiannually, or annually. Payment is due on the date of each renewal period. Email invoices will be sent approximately 2 weeks prior to the renewal date.

Design Services
We will create a website plan to chart the structure of your website, then design a sample home page for your approval. Once you approve the website plan and initial design, we require a deposit of 25% of the estimated total. We require our clients to approve each page upon completion, then issue an invoice for each approved page or group of pages. You pay nothing until you approve the design!

Initial payments are due 7 days from initial setup of service
If you do not expect that your initial payment will arrive within a week of sign-up please contact Strong Webs immediately to avoid account suspension.

Special policy for international users
Strong Webs accepts payment by international money order and other international forms of U.S. currency. If you do not expect initial payment to arrive within 7 days, please fax us a receipt indicating: 1) that payment has been mailed, or 2) that the payment process has been initiated, along with an approximate ETA for your payment.

Invoices
Customers will be invoiced via email. Customers needing a printed invoice can print a copy of the emailed invoice.

Delinquent accounts
Accounts with delinquent balances will be given 48 hours notice (via email). If no response is received in that period, the delinquent account will be suspended. Accounts delinquent for more than 2 weeks are subject to termination.

Cancellation
Strong Webs reserves the right to cancel service at any time for any reason. Should Strong Webs cancel service, all monthly and setup fees will be prorated and refunded. Should the customer cancel Strong Webs service, monthly fees will be prorated and refunded, however, setup fees are not refundable. In either case, InterNIC fees are not refundable.

Billing Policies & Prices
Strong Webs reserves the right to change its policies or prices at any time. Prices are good only for the period of pre-payment. Customers will be notified of changes to prices or billing policy prior to renewal of service agreement.
